I saw an interesting judgment in Sweden where a Man accused of rape was acquitted because the woman was drunk !

So It is Not rape if you Rape a woman who is drunk!

The incident took place in the 46-year-old man’s in November 2013 when the two returned to the man’s apartment after having dinner together at a restaurant inGothenburg.

The 21-year-old woman told the court the last thing she remembers from the evening is falling asleep in the man’s apartment with her clothes on before waking up the following afternoon to find herself locked in a room.

In its decision, the Gothenburg District Court ruled there was no doubt the woman was intoxicated, noting that she was so drunk she “fell to the ground and lay there awhile”, the Metro newspaper reported.

Tests later revealed the woman’s blood alcohol-level was between 2.0 and 2.5 per mille, more than ten times the legal limit in Sweden, putting her in what the court called a “particularly vulnerable situation”.

Reform’s to Sweden’s sex-crime legislation implemented in July 2013 redefined the term “incapacitated state” to “particularly vulnerable situation”, which in effect re-classifies certain types of sexual assault as rape.The reforms were meant to apply to cases where a victim responds to a sexual assault by remaining passive, allowing them to be treated as rape.

But the man told the court that he didn’t realize the woman was drunk when they were back at his flat, adding that during intercourse she was “active” and “made certain noises”.

In acquitting the man of the rape charges, the court ruled it had not been proven that the man “understood or was aware that” the woman was drunk nor that he knowingly acted against the woman’s wishes.”

    I very much doubt that any woman or even anyone with a brain would agree with the courts in Sweden. Such crimes should never go unpunished under any circumstances.

  2. I don’t know what Sweden’s alcohol laws are or if the Blood Alcohol Content findings are written accurately. In New York (USA), there was considerable debate as during the 20th Century many people died while arrested, and alcohol poisoning was determined. The highest content of anyone I arrested was 0.44% BAC; My partner did one at 0.46% BAC; and only one other that I heard of went to 0.52% BAC. The intoxication limit for operating a motor vehicle then, was 1.0% BAC, which today has been lowered to 0.08% BAC, and may possibly get lowered yet. The hospitalization way back when I made the 0.44 arrest, was 0.45% BAC, and about a year or two later was lowered to hospitalization at 0.29% BAC to prevent death, coma, brain damage. It becomes vital for physicians to become involved and hospitalization.
    For what is written, additional charge of Attempted Murder should be added if alcohol was served to the woman and her BAC was “2.0 or 2.5″. Maybe it is meant, 0.20 or 0.25? Then it becomes a matter of body weight and metabolizing ability.
    Rape, in the First Degree would be added due to Intent. Best to see the woman get home safely or call her family. No excuses or justification for rape. It appears that Sweden, so liberal, has degenerated to the ninth century in barbarity against women. No respect for Life.

    • Yes, Who gave Alcohol? If she is a Major, she is responsible for her act. leaving this aside consumption Alcohol is guilty in the long run

      • No idea who gave alcohol but rape inexcusable. That is the bottom line. In America, there is a moral obligation to call police and an ambulance if a person is intoxicated or incapacitated. She could have died. Instead, she was victim of a crime. Courts have upheld this. Appellate Courts have upheld lower court decisions where convicted men tried to have the conviction overturned. Very serious matter, and it always will go against the man involved.

        Rape Laws works both ways,A woman can easily accuse any one of Rape.Please read my posts on this.
        However this is not to condone the present case

      • It should go in both directions for allegations terrible in nature as it is a crime against humanity. What happens too frequently is, a woman gets drunk, knows what she is doing, goes to bed with a man, then when he does not call her again or visit, she makes allegations and he is arrested and charged with rape. Even if not convicted, the woman feels somehow justified for her actions by ruining the man’s life. Nothing police can do, except make the arrest. I tried to explain this to men, and they were completely horrified. Another situation is of prostitutes who for one reason or another, make the same allegations and the man is arrested. Years ago, it was if the woman was a prostitute, or on the streets as a vagrant and consorted with men for sex, she was committing a crime, and became a victim while committing a crime. If the man goes to jail, she goes to prison for her crime. But things changed over the years.
