A 17-year-old girl has been jailed for more than a week now to ensure she testifies against an ex-convict accused of abducting and raping her.
The unidentified Sacramento teen has been held on a material witness warrant to guarantee her presence at the trial of Frank William Rackley, who is accused of three counts or rape, scheduled to begin on April 23.
Rackley, who weighs more than 200 pounds and bears a swastika tattoo on his chest, is charged with raping the girl in his pickup in July. Prosecutors say a rape examination found Rackley’s DNA

The 37-year-old ‘threw [the victim] into the driver’s side of the truck,’ and ‘drove to a dark spot on a residential street and parked,’ before raping the girl and pushing her out of his vehicle, according to court documents.
The girl’s lawyer will ask Judge Lawrence G. Brown to set her client free at a hearing scheduled today.

‘I think it’s outrageous that the DA‘s Office wants to put a rape victim – a juvenile rape victim – in custody, as if she were the criminal, in a case where she is the victim,’ attorney Lisa M. Franco told the Sacramento Bee.
‘What this is serving to do is only making victims out there – potential victims and future victims – not want to come forward because they’re going to have to go to jail, because they’re afraid to testify,’ she added to CBS Sacramento.

  1. I must say that once you report a crime, you should have to testify. We have to realize that we have an over loaded court system.The rapist will be free to attack again, which is putting other women at risk, precious resources are being used, that would be better served helping the one who wants justice; to get it. If you dont want to prosecute then the alternative is to not report the crime. As a past victom of a mugging, i reported, cooperated and justice was served. I feel bad that the victom has to be detained,she has been through enough. Possibly the states need a better facility to house those who have reported crimes but now are reluctant to follow through.

    • It is a shame that the victim/complainant has to be protected.
      While agreeing to the principle that ‘innocents must not be punished’,stringent laws must be in place to jail the accused till the Court delivers the final verdict with no Bail provisions.
      If over crowding of cases is a problem, additional facilities must be opened.

      I find it strange that the Politicians talk non-sense reasons to increase the Judicial facilities.
      Probably they want to ensure that their cases are not heard and disposed of immediately

      • I apologize for not adding that yes, the accused should not be freed, leaving him able to contact or threaten the victom.
